Competition for OverDrive? 3M Cloud Library in Beta with Kansas Libraries

This is a fascinating story from Library Journal. The Kansas State Librarian, Jo Budler, is attempting to move the state's e-books platform from OverDrive to 3M's Cloud Library, which is currently in beta. This isn't a random or capricious choice; staying with OverDrive would mean a 700% increase in the platform licensing fee by 2013. (Any content licensed is in addition to the platform licensing fee.)


The major hurdle here is not losing access to the content they've already paid OverDrive for. OverDrive's contract refers to content as "purchased," but other clauses treat it as "licensed." Ms. Budler has contacted 169 publishers of e-books the Kansas libraries have purchased; 93 of them have agreed that their e-books can be transferred to the new system without an additional fee. The fate of the remaining titles is still in limbo. Also in question is whether the new platform can be in place by November, to avoid a gap in service when the OverDrive contract expires on December 5.

It's worth noting that 3M's contract language says that the content libraries purchase is theirs, and the library can take it with them to a new platform if they end relations with 3M.
